USE OF BRG

External Links and Banners: BRG may provide, or third parties may provide, links to other World Wide Web sites or resources. You agree that BRG may provide banners or links from said sites or parties at its sole discretion. You acknowledge and agree that BRG is not responsible for the content of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that BRG shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.  If you deal with any company or service as a result of seeing a banner or link on our website you do so of your own choice and by way of your own volition.

Content of Ads: All companies and individuals obtaining information, or purchasing or obtaining advertising space on BRG must comply with these TAC. However, all users, and particularly consumers, purchasers, or potential purchasers, acknowledge that we do not verify the truth or accuracy of the information contained in ads posted on our site.  Although discouraged by BRG, and although same may be illegal and a violation of these TAC, many ads may contain “fluff,” “puffery,” “bait and switch” or other claims which may be inflated. We have no ability to independently verify the claims made or information provided by each of our advertisers, and to that effect, you should take your own measures to verify the truth and accuracy of information contained in ads on BRG. We additionally cannot verify the legality or accuracy of any ad which may state or imply the worth or value of any investment, or which may state or imply that any property is being sold as an investment, or which may state or imply the future worth or value of property.

THIS WAIVER OF LIABILITY INCLUDES BUT IS IN NO WAY LIMITED TO STATUTORY CLAIMS, COMMON LAW CLAIMS, ANY INJURIES, DAMAGES, FRAUDS, OR SPECIAL OR CONSEQUENTIAL DAMAGES OR CLAIMS***

We encourage all customers and potential Buyers to research thoroughly all property, developers, and sellers, and to educate themselves with the process and prospect of purchasing property. BRG does not conduct any background check or investigation into the individuals or companies posting ads and content on this site. 

Ad Submissions to BRG

Right to Refuse: BRG reserves the right to refuse any listings, or ads, for any reason, with or without cause.  You hold BRG completely and totally harmless for any cause or action arising or related to any refusal to accept advertising, or any cancellation of advertising.

Compliance with Laws and TAC: You agree that all ads and the content thereof, fully and completely comply with all State and Federal laws, rules, regulations, orders, and codes. You acknowledge that all property advertised for sale is registered with the appropriate governmental or regulatory agencies, or otherwise is not legally required to be so. You acknowledge that you are licensed and/or legally authorized to sell any property listed on this site.  ***YOU HEREBY AGREE TO HOLD BRG COMPLETELY AND TOTALLY HARMLESS, AND TO INDEMNIFY BRG FROM ANY AND ALL CLAIMS, SUITS, CAUSES OF ACTION, DAMAGES, OR LAWSUITS, ACTUAL OR THREATENED, WHICH MAY ARISE OR BE BROUGHT AGAINST BRG AS A RESULT OF, OR RELATED TO, OR INCIDENTAL TO OR ARISING FROM, ANY AD AND/OR THE CONTENT THEREOF, AND/OR ANY STATEMENT OR REPRESENTATION MADE BY YOU IN WRITING OR ORALLY TO ANY THIRD PARTY***

Warranties: BRG does not warranty any result from the posting or placing of any advertising. BRG does not guarantee any profits or sales as a result of the placing or posting of any ads, or as the result of any actions or omissions taken by you upon reliance upon information provided on BRG.

Background Checks: BRG doesn’t verify, investigate or inspect the background for any customer, buyer, or potential Buyer. You, as an owner of property, publicly or privately provide your personal and professional information, contact information, trade secrets, privileged information, and similar information, to prospective purchasers and buyers at your own risk and expense, AND… ***YOU HOLD BRG TOTALLY AND COMPLETELY HARMLESS FROM ANY AND ALL CLAIMS, CAUSES OF ACTION, SUITS, LIABILITIES, ALLEGATIONS AND DAMAGES, OF ANY AND ALL KINDS OR NATURE WHATSOEVER, ARISING FROM OR AS A RESULT OF SAME. You agree that it is your responsibility, solely and only, to conduct proper inquiry and background checks of those contacting you through BRG.

Refund Policy: BRG cares deeply about the satisfaction of every customer we serve. We offer full refunds for any payment for any ad which has not been displayed on our site. However, we cannot offer any refunds once ads have been posted for display on our site. We additionally can offer no refund for any “type-o”s, mistakes, or errors in any advertisements posted on our site. It is your responsibility to ensure that information, including contact information, in your ad is accurate. BRG does not layout, nor provide any design services to customers and does not verify the accuracy of information contained in advertisements. Absolutely no refunds will be given for any reason for ads or content which is in violation of this TAC. No refunds will be given for unavailability of BRG due to technical reasons outside of BRG’s control, or for routine upgrades or maintenance.

Indemnity

In addition to any language above, all individuals, companies, and corporations, who use, visit, or contact BRG for any reason, agree to indemnify and hold BRG, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TAC, or your violation of any rights of another.

JURISDICTION, VENUE and CHOICE OF LAW

***You agree that any dispute arising from this agreement shall be heard, litigated and/or brought forth, in a State Court located in Broward or Palm Beach Counties, Florida, United States, and said forum shall be the only acceptable jurisdiction and forum for said claims or suits.***

You additionally consent that the laws of the State of Florida shall apply to any claim or action arising from this agreement.

CONSENT: By your usage of BRG, you expressly agree that you have (1) read and (2) agreed to these TAC.
